BOOKINGS

Email and telephone bookings are treated as provisional and are only confirmed once the funds have cleared into the The Workout Club Ibiza bank account.
The balance of the fee is payable within 5 working days after receipt of the invoice via email which will be at the beginning of a new booking, activity, service, or at every new month of a package unless otherwise agreed on confirmation by the The Workout Club Ibiza.

In the event that the balance is not paid The Workout Club Ibiza retains the right to treat the booking as cancelled by the client.

PRICE

The price at time of booking covers the cost of the package, booking, activity or service. Once the fee is paid the agreed package will be delivered. If the client wishes to change the package, activity or service once the fee is paid, additional reasonable costs may be calculated by The Workout Club Ibiza at their discretion.

PERSONAL HEALTH AND HISTORY

  1. Except as disclosed in writing in the ‘The Workout Club Ibiza Health History Questionnaire’ (which clients receive by email at the beginning of their first package) the client confirms that they are in good mental and physical health and that they are unaware of any reason why they may be particularly unsuited to taking part in the activity and/or service agreed upon, or why they may be likely to suffer illness or injury during the activity and/or service.
  2. Failure to disclose any information that is required in the ‘TWC-Ibiza Health History Questionnaire’ may result in The Workout Club Ibiza terminating the contract and withdrawing the client from the activity and/or service due to incorrect information. The client is responsible for filling out the Health History Questionnaire. An un-completed Health History Questionnaire may be seen by The Workout Club Ibiza as failure to disclose any information by the client.
  3. The client is responsible for their own personal medical requirements.

 

CANCELLATIONS & REFUNDS

If something goes wrong and you need to cancel

  1. DROP-IN TICKETS & PACKAGES 1x, 3x, 6x, 12x workouts
    • Activity – Group Personal Training
    • Valid – Valid for one year
    • Illness – To illness of a month or more, the client must let the administration of The Workout Club Ibiza know in time (during disease process) by email at info@twc-ibiza.com about the illness. The drop-in tickets or package then will be deactivated. After report about recovery, the drop-in ticket or package can be extended. The Workout Club extends a month per workout. So if anyone has 6 workouts left, we extend to 6 months. In case of illness less than one month, no extension is granted.
    • Vacation – The drop-in tickets and packages will not be deactivated for vacations.
    • Refund – No refund will be given for drop-in tickets and packages.
  2. ONE & THREE & SIX MONTH OR ONE YEAR PROGRAM Unlimited access to sessions
    • Activity – Group Personal Training
    • Valid – Valid for duration of the program
    • Missed sessions – The client is responsible for letting TWC-Ibiza administration know in advance if any sessions are to be missed. For example, in the case of long-term sickness or bereavement. An email to info@twc-ibiza.com is essential in order for TWC-Ibiza administration to freeze any missed sessions until the client returns to training.
    • Refund – No refund will be given for 1, 3, 6-month and 1 year programs.
    • Termination – Termination of a program is possible every new month, 5 working days before the start of a new month. Example; termination email arrives at the administration on January 20, then the program stops on February 1. Cancellation must be written by email: name, desired termination date, and for which program.
  3. ONE & THREE & SIX MONTH OR ONE YEAR PROGRAM 1x, 2x, 3x per week
    • Activity – Personal Training, Small Group Personal Training
    • Valid – Valid for duration of the program
    • Missed sessions – The client is responsible for letting TWC-Ibiza administration know in advance if any sessions are to be missed. For example, in the case of sickness or bereavement. An email to info@twc-ibiza.com is essential in order for TWC-Ibiza administration to freeze any missed sessions until the client returns to training.
    • Refund - No refund will be given for 3 and 6-month or one year programs.
    • Termination – Termination of a package is possible every end of a program, 5 working days before the start of a new program. Example; Program started on January 1 and ends at end of March. Termination email arrives at the administration on January 20, then the program stops on April 1. Cancellation must be written by email: name, desired termination date, and for which program.

COMPLAINTS

If there is a problem during the activity and or service period you must report it in the first instance to the coach or teacher of your activity. If it is still unresolved you must then report it to the management team immediately so that prompt and effective efforts can be made to resolve the problem.

Please include your contact telephone number. Failure to take these steps will prejudice our ability to resolve your problem and/or investigate it fully, therefore, any right to compensation you may otherwise have had will be lost or substantially reduced.

LAW AND JURISDICTION

This agreement shall be construed in accordance with the laws of Spain and the Courts of Spain shall have exclusive jurisdiction in relation to any matters arising out of this Agreement.

PRINTING AND TYPOGRAPHICAL ERRORS ARE RESERVED

We put in every effort to encounter printing and typographical errors. However changes can occur and printing and typographical errors are reserved. We reserve the right to change information and pricing.

CANCELLATION OF PERSONAL APPOINTMENTS BY THE CLIENT

The Workout Club Ibiza has a 24 hour cancellation and rescheduling policy for all personal appointments, including Personal Training, Yoga and Treatments. Should we receive less than 24 hours notice of cancellation or rescheduling, then the client will be charged the full cost of the personal appointment. This policy is in place as the coach, teacher or therapist must still be paid by The Workout Club Ibiza in the event of a “no show” for a scheduled appointment.

CANCELLATION OF SESSIONS BY TWC-IBIZA

If TWC-Ibiza needs to cancel any sessions due to bad weather conditions or illness of a coach or teacher, every effort will be made to inform the client in reasonable time.

CONDITIONS OF SERVICE

As part of the continual review of safety and associated considerations these Terms and Conditions are subject to change clarification and modification at any time. Only the TWC-Ibiza management team is empowered to vary or waive any of the Terms and Conditions. Such decisions are totally at the discretion of the management team.
